Terms of Service for FluxNSFW.ai

1. Acceptance of Terms

By using the Service, you affirm that you are of legal age to enter into this agreement, or, if you are not, that you have obtained parental or guardian consent. You also affirm that you are legally permitted to use the Service and take full responsibility for the selection and use of the Service.

2. Changes to Terms

What constitutes a material change will be determined at our sole discretion. 3. Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

Our Service allows you to provide input ("Prompts") and generate content, such as images or text ("Generated Content"), based on those Prompts.

Acceptable Use: You agree not to use the Service to create content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Violates any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
• Depicts non-consensual sexual content.
• Promotes violence, discrimination, or illegal activities.
• Involves the exploitation of minors.

Responsibility for Content: You are solely responsible for the Prompts you provide and the Generated Content you create. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Generated Content. You understand that by using the Service, you may be exposed to content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will we be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content generated or made available via the Service.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of FluxNSFW.ai and its licensors. The Service is protected by copyright, trademark, and other laws of both Singapore and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FluxNSFW.ai.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Violating or encouraging others to violate the rights of third parties, including intellectual property rights.
• Posting, uploading, or distributing any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate (subject to the specific nature of FluxNSFW.ai, define boundaries carefully).
• Interfering with security-related features of the Service.
• Interfering with the operation of the Service or any user's enjoyment of the Service, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code, making unsolicited offers or advertisements, or attempting to collect personal information about users or third parties without their consent.
• Accessing, tampering with, or using non-public areas of the Service, our computer systems, or the technical delivery systems of our providers.
• Performing any fraudulent activity, including impersonating any person or entity, claiming false affiliations, or accessing the accounts of others without permission.
• Attempting to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service or any part thereof.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

FluxNSFW.ai, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements or expectations.

Disclaimer Regarding Generated Content: The content generated by the AI is probabilistic and may not be accurate, appropriate, or free from biases. You acknowledge that FluxNSFW.ai has limited control over the Generated Content and you use it at your own risk. We are not responsible for any decisions or actions taken based on the Generated Content.

9. Limitation of Liability

In no event shall FluxNSFW.ai, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service, including Generated Content; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
